Lindsay Lohan To Be Released From Jail

Actress will reportedly have to wear SCRAM bracelet again upon release.

Lindsay Lohan is expected to be a free woman once again after a second judge agreed with her lawyer that the actress is entitled to bail.

Since Lohan's jailing Friday (September 24), lawyer Shawn Chapman Holley was reportedly working to get her client the option of posting bail. The Los Angeles Times reports that on Friday afternoon, Los Angeles County Superior Court Judge Patricia M. Schnegg overturned Judge Elden Fox's order and granted the actress $300,000 bail. TMZ adds that Lohan will have to be outfitted with a SCRAM bracelet within 24 hours and avoid venues where alcohol is the "chief item of sale." Lohan sported a SCRAM bracelet this summer, which reportedly went off at a party, an incident that ultimately led to her July prison sentence.

Lohan was sent to prison exactly one week after she admitted to failing a court-ordered drug test, the screening being one of many conditions the starlet had to adhere to after back-to-back stints in jail and rehab. Judge Fox ordered Lohan to be held without bail until a scheduled October 22 hearing in the case. The move was reportedly a tactic to keep the actress in prison instead of sentencing her outright, which might have cleared the way for early release due to overcrowding.

"Ms. Lohan cannot be released early because this isn't a jail sentence," L.A. Sheriff's spokesman Steve Whitmore told People on Friday. "She's being held by court order until her hearing on October 22. She will be held in the same conditions as her last stay, in a keep-away unit."

Lohan has been frank about her struggles with addiction and recently tweeted about her willingness to face the repercussions of her actions after reports of her failed drug test surfaced.

"Regrettably, I did in fact fail my most recent drug test and if I am asked, I am prepared to appear before judge Fox next week as a result," Lohan tweeted last Friday. "Substance abuse is a disease, which unfortunately doesn't go away over night. I am working hard to overcome it and am taking positive steps forward every day. I am testing every single day and doing what I must do to prevent any mishaps in the future. ... This was certainly a setback for me but I am taking responsibility for my actions and I'm prepared to face the consequences."

In July, Lohan served 13 days of a 90-day jail sentence over a probation violation stemming from a 2007 DUI conviction. She followed up the jail time with 23 days court-ordered rehab, a fraction the court's original mandate of 90 days.
